Scheme description

Subdivision of land at 2 Brindwood Road and construction of one two-storey residential unit (1x2-bed) (Use Class C3) together with hard and soft landscaping, boundary treatment, one parking space, refuse and recycling storage facilities, bicycle parking provision and air source heat pump.

Why it was refused
Reason 1

The design of the proposed dwelling, combined with the contrived nature of the subdivision, would result in a visually disjointed and poorly integrated development. This would undermine the appearance of the host semi-detached pair and negatively impact the wider streetscene. As such, the proposal is contrary to Policies D1 and D4 of the London Plan (2021), and Policy 53 of the adopted Waltham Forest Local Plan Part 1 (2024).

Reason 2

Overall, the proposed layout results in poor daylight and sunlight provision to the proposed dwelling, compounded by the provision of inadequate private amenity space. The proposal is therefore contrary to the requirements of Policy 56 of the adopted Waltham Forest Local Plan and Policy D6 of the London Plan (2021).

Reason 3

In the absence of a submitted Tree Survey or AIA , the applicant has failed to provide sufficient detail to assess the potential impact of the development on existing trees. As such, the proposal is contrary to Policy G7 of the London Plan (2021) and Policies 79 and 80 of the adopted Waltham Forest Local Plan LP1 (2024).

Reason 4

In the absence of the Small Sites Metric, and due to a lack of information confirming how the proposed offsite biodiversity units have been or will be formally allocated to the development through registration on the statutory Biodiversity Gain Site Register, the application fails to provide sufficient detail to fully assess the biodiversity impacts of the proposal. As such, it fails to satisfy the requirments of Policy 79 of the adopted Waltham Forest Local Plan LP1 (2024).

Reason 5

Notwithstanding the above reasons, a S278 and S106 agreements are not entered to ensure the development is in compliance with Policy DF1 of the London Plan (2021), Policies 3, 46, 66, 85, 87 and 94 of the adopted Waltham Forest Local Plan LP1 (2024), in relation to the following planning obligations requirements: S278 Agreement for highway related works, to be paid by developer and implemented by Local Highway Authority: Upgrade of the footway on Brindwood Road adjacent to the application boundary. Financial contribution of £250.00 towards monitoring of the Construction Logistics Plan Financial contribution on any shortfall if 35% carbon reduction is not achieved. Financial contribution of £650.00 towards Strategic Access Management and Monitoring Strategies (SAMMS) against mitigating the impact of the development upon the Epping Forest Special Area of Conservation (SAC). Monitoring Fee - A financial Contribution towards the implementation and monitoring of and securing compliance with the s106, equal to 5% of the total of all other financial contributions Legal Fees - Payment of the Council's legal fees for the preparation and completion of the Legal Agreement.
