The application as submitted comprises of inconsistent plans and insufficient detailing, relating to (i) proposed windows to the ground floor side elevations (ii) number and location of proposed rooflights (iii) absence of rear elevation plan. As such it is not possible to establish that the development complies with Policies 53, 56, 57 of adopted Waltham Forest Local Plan LP1 (2024).
The proposed development would result in a cramped and unsatisfactory form of living environment for the future occupiers failing to meet minimum space standard requirements, contrary to Policy 56 of the adopted Waltham Forest Local Plan LP1 (2024), Department for Communities and Local Government “Technical Housing Standards-National Described Space Standards” March 2015, and London Plan Supplementary Planning Guidance “Housing” (2016).
In the absense of the submission of a Tree Survey and Arboricultural Impact Assessment, to identify the impact of the development on trees located within the vacinity of the development, along with the required protection and mitigation measures, a full assessment of the acceptability of the development and assurance of the protection of local biodiversity cannot be carried out, and therefore it cannot be confirmed that the development would be in compliance with Policy 80 of the adopted Waltham Forest Local Plan LP1 (2024).
The Outline Contruction Logistic Plan as submitted, fails to adequately demonstrate how the proposed development could be built or serviced without severely affecting public highway and therefore fails to comply with the requirements of Policies T7 of the London Plan (2021) and Policy 65 of the adopted Waltham Forest Local Plan LP1 (2024).
The applicant has failed to enter into a S106 agreement and therefore not in compliance with Policy 94 of the adopted Waltham Forest Local Plan LP1 (2024) and the Waltham Forest Supplementary Planning Document “Planning Obligations” SPD, specifically in relation to the following planning obligations requirements: Secure car free development Financial contribution of £2,000 towards walking and cycling infrastructure. Financial contribution of £250 towards CLP monitoring. Financial contribution of £1254 towards Epping Forest SAMM & SANGs
