Change of use of part of ground floor from retail (Use Class E1) to 1 x studio flat (Use Class C3) (Application for Prior Approval under Schedule 2, Part 3, Class M of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended))
Reason for Refusal: Having regard to the immediate surrounding area of the site, it is considered that insufficient information has been submitted in order to enable the Local Planning Authority to establish whether the development complies with Condition M.2-(1)(f) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) in respect of the provision of adequate natural light in all habitable rooms of the dwellinghouse. The proposed development, by reason of its siting, would likely have implications for the viability of using the remaining premise as a retail unit that would be harmful to the sustainability of this key shopping parade contrary to the provisions of Policy DMTC 3 of the Hillingdon Local Plan: Part Two - Development Management Policies (2020) and prior approval is refused having regard to the provisions of Condition M.2-(1)(d)(ii) of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). The proposed development does not constitute permitted development, under Schedule 2 Part 3, Class M of the Town and Country Planning (General Permitted Development) Order 2015 as the proposal includes changes to the facade to the adjoining commercial unit which would not serve the new unit being created through the prior approval. Additional works proposed indicate it falls outside the red line boundary. Inaccurate plans/elevations have been received and the information provided conflicts with the Local Planning Authority's records. In light of such, the officer was unable to fully assess the application.
