Variation of Condition 10 of planning permission dated 14th May 2025 (25/01940/FULL) for: Use of lower ground and ground floors as a restaurant with ancillary takeaway; external alterations comprising the installation of a new shopfront, installation and replacement of condenser units to the rear, replacement metal staircase within rear yard and installation of ancillary services to rear facade including replacement of existing metal panel over the kitchen door. Namely, to extend restaurant opening hours to 11:00 to 00:30 Monday to Thursday; 11:00 to 01:30 Friday and Saturday; and 12:00 to 00:30 Sundays, bank holidays and public holidays.
The proposed opening hours would be inappropriate in this location and would add to late-night activity and disturbance, harming the character and function of the area, the quality of the area's environment and would increase levels of noise disturbance and cause late night disturbance for the community in the area, including nearby residents on the upper floors of neighbouring properties on Eccleston Street, harming residential amenity at particularly noise senstive hours. This would not meet Policies 7, 18, 20, 37 and 42(C) of Westminster's City Plan 2019 - 2040 (January 2026).
