Variation of Condition 1 of planning permission dated 5 January 2024 (RN: 23/02189/FULL) for 'Erection of single storey rear extension and alterations to front elevation including new windows and doors and enlarged front lightwell with stair'. NAMELY, to add new cast stone parapet screening, decorative architrave to windows, decorative metal screen to front windows, replacement of decorative balustrade with black painted metal balustrade, projecting portico and columns to entrance and coping stone to existing boundary wall.
The proposed changes to the parapet screening, projecting portico and columns to entrance and coping stone to existing boundary wall would change the operative part of the development that we approved on 05 January 2024 (23/02189/FULL. Applications under Section 73 of the Town and Country Planning Act 1990 (as amended) may not be used to amend the operative part of a planning permission or to impose conditions which would be inconsistent with the operative part of the original planning permission.
Because of the parapet screening, architrave to windows, metal screen to front windows, balustrade with black painted metal balustrade, projecting portico and columns to entrance and coping stone to existing boundary wall, the works would harm the appearance of this building and fail to maintain or improve (preserve or enhance) the character and appearance of the Bayswater Conservation Area. This would not meet Policies 42, 44 and 45 of the City Plan 2019 - 2040 (January 2026). (X16AD)
