Excavation of basement and creation of a lightwell together with associated alterations to create a one-bedroom house to building at rear of garden.

Why it was refused
Reason 1

The proposed dwelling by reason of its location within part of an undeveloped residential garden would be an inappropriate form of development. This is compounded by the extent of the basement works that would develop more than a maximum of 50% of the garden plot and would fail to provide a minimum of 1.2 metres of natural draining permeable soil above any part of the basement beneath the garden. Together with the lightwell screening, alterations to boundary treatment and introduction of other residential paraphernalia the proposal would result in harm to the architectural and historic significance of the grade II listed heritage asset and character and appearance of the Nightingale Lane Conservation Area. As such, the scheme fails to comply with Policies LP1, LP3, LP6 and LP7 of the Local Plan (2023), policy HC1 of the London Plan (2021), the NPPF (2024) and the Housing SPD (2016).

Reason 2

By reason of design and internal arrangement, the development would fail to provide an acceptable standard of accommodation for future occupiers. The scheme would provide an oppressive environment with poor quality outlook provision at basement level and inadequate levels of privacy for future occupiers within the ground floor habitable room and garden areas as a result of actual and perceived overlooking from neighbouring properties. As such, the proposal would create a dwelling with substandard accommodation for future occupiers and therefore fails to comply with policies LP27 of the Wandsworth Local Plan (2023) and policy D6 of the London Plan (2021) and the Housing SPD (2016). 2 The application has failed to demonstrate reasonable means of excavation and construction, including an acceptable strategy for the removal and storage of excavated spoil for the proposed development, to the detriment and disruption to the highway network. Therefore, the application proposal therefore fails to comply with policies LP2, LP14 and LP50 of the Wandsworth Local Plan (2023) and the Housing SPD (2016). In dealing with this application the Council has implemented the requirement in the National Planning Policy Framework to work with the applicant in a positive and proactive manner and the Council has, as far as practicable, sought solutions to problems arising in relation to dealing with the planning application. We have made available detailed advice in the form of our statutory policies in the Local Plan as well as offering a full pre application advice service. However, we have been unable to seek solutions to problems as the proposal is clearly contrary to our statutory policies and negotiation could not overcome the reasons for refusal.
