Why it was refused
Reason 1

The ventilation extract system, by reason of its design and proximity to neighbouring residential windows, would result in unacceptable harm to the amenity of nearby occupiers through the emission of odours and noise disturbance. As such, the proposal fails to protect residential amenity and is contrary to Policies LP2 and LP14 of the Wandsworth Local Plan (2023). Director of Place: Paul Moore

Reason 2

The site lies within Flood Zones 2 and 3a, where a Flood Risk Assessment is required. No such assessment has been provided, and the proposal therefore fails to demonstrate that flood risk would be adequately managed and is therefore contrary to Policy LP12 of the Wandsworth Local Plan (2023). In dealing with this application the Council has implemented the requirement in the National Planning Policy Framework to work with the applicant in a positive and proactive manner and the Council has, as far as practicable, sought solutions to problems arising in relation to dealing with the planning application. We have made available detailed advice in the form of our statutory policies in the Local Plan as well as offering a full pre application advice service, in order to ensure that the applicant has been given every opportunity to submit an application which is likely to be considered favourably. In addition further guidance was offered to the applicant by the case officer during the processing of the application to identify amendments to address those elements of the scheme considered unacceptable. Required amendments: Should a future application be submitted, Officers advise that all odour and noise mitigation measures be included and that the extract system be designed to terminate vertically, directing emissions away from nearby residential windows. Please be aware, that a vertical termination point may raise different visual amenity impacts that would need to be assessed against relevant planning policy following consultation with neighbouring properties.
