Demolition of existing houses and erection of three-storey (plus basement) detached house. Erection of single-storey outbuilding plus basement with ramped access. Landscaping including replacement of boundary treatment.

Why it was refused
Reason 1

The demolition of two family dwellinghouses and proposed replacement with a single dwellinghouse would result in the net loss of a family-sized residential unit within the Borough. The principle of the development would therefore fail to comply with policy DMH1 of the Development Management Policies Document (2016), the NPPF (2019), the London Plan (2016), the Mayors Housing SPG (2016). Reason 2

The proposed development, by reason of its scale and design, would constitute an unneighbourly form of development that would appear overbearing, result in an increased sense of enclosure and harm the outlook for the occupiers of the neighbouring property at No. 42 Alfriston Road. The application has also failed to demonstrate that the scale and form of the proposal would not materially harm the existing daylight and sunlight levels to the adjoining property. The proposals would therefore be contrary to policy DMS1 of the Development Management Policies Document (2016) and the guidance provided in the Housing SPD (2016). In dealing with this application the Council has implemented the requirement in the National Planning Policy Framework to work with the applicant in a positive and proactive manner and the Council has, as far as practicable, sought solutions to problems arising in relation to dealing with the planning application. We have made available detailed advice in the form of our statutory policies in the Local Plan consisting of the Core Strategy, Development Management Policies Document, Supplementary Planning documents and where appropriate the Site Specific Allocations Document as well as off ering a full pre application advice service. However, we have been unable to seek solutions to problems as the principle of the proposal is clearly contrary to our statutory policies and negotiation could not overcome the reasons for refusal.
