Why it was refused
Reason 1

The rear extension by reason of its inappropriate scale and massing, results in an incongruous, overly dominant and excessive level of development for the host property and its open rear garden setting to the harm of local visual amenity. The proposal therefore fails to comply with the NPPF (2019) policies DMS1 and DMH5 of the Wandsworth DMPD (2016) as well as the guidance within the Housing SPD (2016).

Reason 2

The extension by reason of its length and height represents an unduly dominating and unneighbourly addition, which has a detrimental impact on the amenity of neighbouring occupiers in terms of loss of outlook, being visually overbearing and creating a sense of enclosure. The extension therefore does not comply with the NPPF (2019), the London Plan (2016), policy DMS1 of the DMPD (2016) and the guidance within the Housing SPD 2016). Director of Environment and Community Services: Paul Chadwick Enforcement Action: For the reasons set out above it is considered expedient and in the public interest to initiate formal enforcement action to secure removal of the unauthorised extension. This action may consist of issue of an enforcement notice, prosecution proceedings and the taking of direct action pursuant to sections 172, 178 and 179 of the Town and Country Planning Act 1990 (as amended). In dealing with this application the Council has implemented the requirement in the National Planning Policy Framework to work with the applicant in a positive and proactive manner and the Council has, as far as practicable, sought solutions to problems arising in relation to dealing with the planning application. We have made available detailed advice in the form of our statutory policies in the Local Plan consisting of the Core Strategy, Development Management Policies Document, Supplementary Planning documents and where appropriate the Site Specific Allocations Document as well as offering a full pre application advice service. However, we have been unable to seek solutions to problems as the principle of the proposal is clearly contrary to our statutory policies and negotiation could not overcome the reasons for refusal.
