Change of use from Class A1 (retail) and Class B2 (bakery) Class A5 (takeaway), to commercial kitchen with hot food takeaway and delivery service (Sui Generis and installation of a new extraction system (part retrospective - part proposed)
The proposal would result in a detrimental impact to neighbouring residential amenity by way of odour and fumes as a result of the low level discharge and inadequate mitigation contrary to the NPPF 2024; and policies P56 Protection of Amenity and P65 Improving Air Quality of the Southwark Plan 2022 southwark.gov.uk 1 Southwark Council, www.southwark.gov.uk/followus London SE1P 5LX
The proposal would result in a detrimental impact to neighbouring residential amenity by way of noise and distrubance as a result of the inadequate noise assessment in regards to the kitchen plant and increased activity late at night seven days a week contrary to the NPPF 2024; and policy P56 Protection of Amenity and P66 Reducing noise pollution and enhancing soundscapes of the Southwark Plan 2022
The proposal would result in a detrimental impact to the highway network due to the location of the site on a red route, without adequate parking available and cycle parking not being reasonably close. Regular deliveries and pickups until 11PM seven days a week would continue the obstruction of the public highway and blue badge parking spaces, cause disruption for pedestrians and increase the volume of traffic contrary to the NPPF 2024; policies T4 Assessing and mitigating transport impacts and T7 of the London Plan 2021 and policies P50 Highways impacts and P56 Protection of Amenity.
The proposal has not been demonstrated to be safe in the event of a fire, and a planning fire safety strategy is required for the proposal given the change of use and intensification of activities that increase fire risk. The proposal is therefore contrary to the NPPF 2024; and policy D12(A) of the London Plan 2021.
