Scheme description

Change of use from part ground floor office (Class E) and first floor extension to provide a one-bedroom 2-person flat, associated with separate bin and cycle storage.

Why it was refused
Reason 1

In absence of a legal agreement, the proposed development fails to fulfil the requirements of self-build exemption in application of Policy P1: Social Rented and Intermediate Housing of Southwark Plan 2022. The proposed development therefore fails to satisfy the policy requirement of providing the maximum amount of affordable housing contribution towards the delivery of new council social rented and intermediate homes with a minimum of 35% subject to viability.

Reason 2

In absence of a legal agreement, the proposed development fails to provide outdoor amenity space contribution in mitigation of the shortfall of the on-site amenity standards identified in Residential Design Standards 1 SPD (2015). As such, the proposed development runs contrary to the requirements of Residential Design Standards SPD (2015), Section 106 Planning Obligations and Community Infrastructure Levy SPD (2020) and Policy P15 Residential Design of Southwark Plan 2022.

Reason 3

By reason of excessive scale and massing, the proposed extension would represent an intensive and overly dominant backland development in relation to the surrounding properties and the local area. The lack of coherency in the design between the new extension and the existing outbuilding would also create an uninviting and top-heavy appearance to the detriment of the character of the streetscape. As such, the proposed development fails to accord with policies P14 Design quality and P15 Residential Design of the Southwark Plan (2022); policy D3 Optimising site capacity through the design-led approach of the London Plan (2021); and Chapter 12. Achieving well-designed places of the NPPF (2021).

Reason 4

The proposed development fails to demonstrate acceptable levels of sunlight and daylight impacts on the surrounding properties owing to the lack of supporting evidence. The proposed development therefore fails to meet Policy P56 Protection of amenity of Southwark Plan 2022.

Reason 5

The proposal would demonstrate inadequate capacity to provide the policy-compliant number of cycle parking with the required design specifications. The proposed development therefore fails to meet the policy requirements of Policy T5 (Cycling) of London Plan and Policy P53 of Southwark Plan 2022.

Reason 6

By reason of an inadequate refuse store area, the proposal fails to demonstrate sufficient provision of refuse storage and prevention of any obstruction to the adjacent footway. As such the proposed development is in contrary to Policy D4 Delivering good design of London Plan 2021, Policy P62 Reducing Waste and Policy P56 Protection of Amenity of Southwark Plan 2022.
