(Part-retrospective) Erection of an open, first floor rear extension for use as a roof garden.
The erection of a first-floor rear extension for use as a roof garden, by reason of its discordant design, would fail to respect the character and appearance of the host dwelling and neighbouring properties. This is considered detrimental to the established local character, and would form un-neighbourly development. Therefore, the proposal is contrary to: The National Planning Policy Framework (2023); Policies D1 and D4 of the London Plan (2021); Policies S6, SP1, SP3, SP8 and H1 of the London Borough of Newham Local Plan (2018); and The Altering and Extending Your Home SPD (2018).
The erection of a first-floor rear extension for use as a roof garden would give rise to the potential for a harmful loss of neighbouring amenity resulting from direct overlooking; a loss of privacy; and increased levels of noise and disturbance. The noise impact would be exacerbated by its elevated position and proximity to habitable rooms at first floor level of neighbouring properties. Therefore, the proposal is contrary to: The National Planning Policy Framework (2023); Policies D1 and D4 of the London Plan (2021); Policies S6, SP1, SP3, SP8 and H1 of the London Borough of Newham Local Plan (2018); and The Altering and Extending Your Home SPD (2018).
