Why it was refused
Reason 1

Character The proposed new dwellinghouse by reason of its siting, scale, bulk, incongruous flat roof formation, building lines projecting in front and the rear of the adjacent terrace, and poor design which lacks architectural detailing and visual interest shape, fails to respect the scale, form and character of the subject and surrounding dwellings. The proposal therefore represents a development that would negatively impact the character and appearance of the area including the street scene. The proposal is therefore contrary to:  The National Planning Policy Framework (MHCLG, July 2021)  Policies D1, D3, D4 and D8 of The London Plan (GLA, March 2021)  Policies S1, SP1, SP3 and SP8 of the Newham Local Plan (December 2018)  Housing Supplementary Planning Guidance (GLA, March 2016, Updated August 2017.

Reason 2

Neighbouring Amenity The proposal has failed to demonstrate that the proposed development would not result in unacceptable impacts to the neighbouring property no. 9 David Street in terms of loss of daylight and sunlight. Furthermore, the increase in bulk and massing is considered to result in a loss of outlook and a resulting sense of overbearing and enclosure. The cumulative impacts arising from the proposal are considered to result in undue harm to the amenities of this neighbouring property. The proposal therefore constitutes an unneighbourly form of development contrary to:  The National Planning Policy Framework (MHCLG, July 2021))  Policies GG4, D1, D3, D4 and D6 of the London Plan (GLA, March 2021)  Policies SP1, SP2, SP3 and SP8 of the Newham Local Plan (December 2018)  Housing Supplementary Planning Guidance (GLA, March 2016, Updated August 2017).

Reason 3

Quality of Accommodation The proposal would give rise to a poor standard of accommodation to the detriment of the living conditions of future occupiers by reason of its insufficient internal floor space and built in storage space. The proposed dwelling size and its configuration would result in cramped and cluttered internal living conditions to the detriment of the health and wellbeing of the future occupants. The proposed development is therefore contrary to:  The National Planning Policy Framework (MHCLG, July 2021)  Policies GG4, D3 and D6 of The London Plan (GLA, March 2021)  Policies S1, S6, SP1, SP2, SP3, SP8 and H1 of the Newham Local Plan (December 2018)  Housing Supplementary Planning Guidance (GLA, March 2016, Updated August 2017).

Reason 4

Biodiversity The application has provided insufficient information to justify the removal of the mature tree to the west of the application site and its loss would be harmful to the character and amenity of the locality. Furthermore, Officers are not convinced based on the apparent inaccuracies of the submitted documents that the remaining existing mature trees would not be unacceptably harmed by the development. The deficiencies in information inhibit the ability Local Planning Authority to make a full and proper assessment of the proposals against the National Planning Policy Framework (MHCLG, July 2021); Policies D3, D8, G5 and G7 of the London Plan (GLA, 22/02146/FUL Page 2 of 5 March 2021), Policies SP1, SP3, and SC4 of the Newham Local Plan (December 2018) in respect of seeking to maintain and enhance biodiversity value and character of the area. Furthermore, Officers are not convinced that such potential harmful impacts could have reasonably been mitigated through conditions or planning obligations.
