Change of use of the ground floor from a shop (Use Class E (a) to a Take Away for Charity purposes (Sui Generis) with alterations made to the front elevation.
The application site lies within an identified hot food takeaway hotspot and the proposed hot food takeaway would further intensify the cumulative impacts of the overconcentration of such uses in this area. Additionally, the site is located in close proximity to a primary school. A hot food takeaway at this location would therefore further undermine the Council's objectives of promoting healthy lifestyles, reducing health inequalities and creating healthy neighbourhoods. The proposal is therefore considered contrary to: The National Planning Policy Framework (DLUHC, September 2023); Policies GG3 and Policy E9 of the London Plan (GLA, March 2021); and, Policies SP1, SP2, SP3 and SP9 of the Newham Local Plan (LBN, December 2018).
Notwithstanding reason for refusal 1, the proposal has failed to demonstrate that the application site would be able to appropriately be able to gather, store and put out waste and recycling for the cafe/restaurant, without restricting use of the surrounding pavements or roads. The application details have not included any information for how waste will be collected, or by whom, and Officers cannot deduce any potential storage location from the proposed drawings. Therefore, this proposal is contrary to The National Planning Policy Framework (DLUHC, September 2023); Policy SI7 of the London Plan (GLA, March 2021); and, Policy INF3 of the Newham Local Plan (LBN, December 2018).
