Application to determine if prior approval is required for change of use from offices (Use Class B1(a)) to residential flats (Use Class C3) over first, second and third floors at 4-6 Lee High Road SE13, pursuant to the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended), Schedule 2, Part 3, Class O.
The proposed development by reason of not providing ten (10) long-stay and two (2) short-stay cycle parking spaces that are accessible, secure, weatherproof and fit for purpose would fail to contribute to the Council’s objectives of encouraging sustainable and comply with conditions of Schedule 2, Part 3, Class O, O.2 (1)(a) of the Town and Country Planning (General Permitted Development) Order 2015 (as amended); Policy T5 'Cycling' of the London Plan (March 2021); and Policy 14 'Sustainable movement and transport' of the Lewisham Core Strategy (June 2011).
The submitted Unilateral Undertaking ("UU") of a section 106 agreement does not adequately restrict future occupier(s) of the development from obtaining parking permits within the Controlled Parking Zone. Therefore in the absence of an acceptable UU, the proposal would be contrary to Schedule 2, Part 3, Class O, O.2 (1)(a) of the Town and Country Planning (General Permitted Development) Order 2015 (as amended); Policy T6 of the London Plan (March 2021) and Policy 14 'Sustainable movement and transport' of the Lewisham Core Strategy (June 2011).
