Scheme description

Conversion of the first floor into 2 residential units (1x 1-bed and 1 studio), including rear extensions. Reconfiguration of the ground floor and conversion of 2 studio units into cycle room and ancillary spaces, plus other internal and external alterations, the installation of 2 side doors and the provision of refuse store. Internal alterations from two-bed to one-bed to the second floor Flat, including the installation of 2 rear windows. Why it was refused
Reason 1

It has not been demonstrated that there is no demand for the lawful existing office floorspace which would need to be evidenced by the office having been vacant and continuously marketed for a period of at least two years. Furthermore, no evidence has been provided to demonstrate that it would not be feasible and or viable to Lambeth Planning Telephone 020 7926 1180 PO Box 80771 www.lambeth.gov.uk London planning@lambeth.gov.uk SW2 9QQ REFULZ refurbish the existing lawful office floorspace in order to meet the requirements of existing or future occupiers or to adapt the office floorspace as smaller office units to meet the demands from small business. As such, the proposal to change the use of the building from office to residential is contrary to Policy ED1 of the Lambeth Local Plan (2021) and Policy E1 of the London Plan (2021).

Reason 2

All proposed flats would fail to meet the Nationally Described Space Standards in respect of floorspace. The flats would also not be provided private amenity space. As such the proposals would provide poor quality accommodation and fail to comply with Policy H5 of the Lambeth Local Plan 2020- 2035 (2021) and Policy D6 of the London Plan (2021).

Reason 3

The proposed rear extensions and proposed windows by reason of their scale and design are incongruous and alien features which would detract from the special character and appearance of the listed building, failing to preserve the special interest of the Grade II listed building (209 Clapham Road) and would undermine the architectural integrity of the host building. This is contrary to Policies Q5, Q11 and Q20 of the Lambeth Local Plan 2020-2035 (2021). Less than substantial harm to the significance of the listed building would not be outweighed by public benefits, contrary to the provisions of the NPPF (2024), para 215.

Reason 4

The applicant has failed to demonstrate that the existing place of worship would meet the requirements of Policies S2 and T1 of the Lambeth Local Plan (2021). The application fails to demonstrate that the use can be controlled in such a way that does not result in harm to the amenity of neighbouring residential properties with regard to noise and disturbance, contrary to Policy Q2 of the Lambeth Local Plan (2021).

Reason 5

In the absence of a legal agreement to secure the development as car-permit free, provision of a car club membership and cycle hire membership, the transport impacts of the development would not be fully addressed, and it would fail to promote less private car ownership and sustainable travel. The application is therefore contrary to Policies T1, T3 and T6 of the Lambeth Local Plan (2021).
