Installation of 4 solar panels to each dwelling (Application for a Certificate of Lawful Development for a Proposed Development).
The proposed development does not constitute permitted development by virtue of the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) because the Council is in possession of evidence showing that the dwellings at 188 Bury Street are currently under construction and were not occupied at the date of the application for Certificate of Lawful Development for a Proposed Development (i.e. 1st February 2023). Accordingly, permitted development rights are not available the dwellings that are under construction at the site.
The proposed development does not constitute permitted development by virtue of the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended) because the on-going effect of Condition 7 of planning permission 8697/APP/2020/3622 which has been re-attached to S.73 planning permissions 8697/APP/2021/1342 and 8697/APP/2022/2216, is to require planning permission for roof alterations in this case is that would otherwise have been permitted. The proposed solar panels would constitute as a roof alteration, and would therefore not be lawful under the provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). This determination is based on your submitted plans. All measurements are taken from existing ground level.
