Why it was refused
Reason 1

The proposed development, which would involve a high number of patrons attending events of a wide variety of description, would result in significant adverse noise and disturbance impacts. In addition it would cause noise disturbance to the adjacent Mark Street Gardens. This would be detrimental to the living conditions of nearby residential occupiers and of use of the Gardens by the community, conflicting with Policies LP2 (Development and Amenity), LP38 (Evening and Night Time Economy) and LP58 (Improving the Environment - Pollution) of the Hackney Local Plan (2020). Furthermore, it fails to meet the standards set out in D14 (Noise) of the London Plan (2021), which aim to protect residential amenity from excessive noise.

Reason 2

The proposed development, by reason of the high number of patrons, the narrowness of the surrounding highways and an absence of adequate submitted documents in relation to Transport impacts, would result in unacceptable impacts to the local Highways network. As such the proposed development is contrary to London Plan (2021) policies T3 (Transport capacity, connectivity and safeguarding), T4 (Assessing and mitigating transport impacts), T5 (Cycling), T6 (Car parking) and T7 (Deliveries, servicing and construction) and Hackney Local Plan (2020) policies LP42 (Walking and Cycling), LP43 (Transport and Development), LP44 (Public Transport and Infrastructure) and LP45 (Parking and Car Free Development)

Reason 3

The proposed development, which does not include level access to and from the venue and which has its toilets outside the venue without level access shown on the submitted drawings, is not properly inclusive or accessible. As such the proposed development is contrary to London Plan (2021) Policy D5 (Inclusive design) and Local Plan Policy LP1 (Design quality and Local Character).

Reason 4

The proposed development, which relies on a single width stair for the entrance and egress of patrons, which is supported by an out of date Fire Safety Report, and which does not include emergency lighting, fire alarms and fire safety signage that would also require Listed Building Consent, is considered to be contrary London Plan (2021) Policy D12 (Fire Safety).
