Change of use of an existing private car park (Sui Generis) to a MOT Testing Centre (Sui Generis).

Why it was refused
Reason 1

The proposed change of use of the site from ancillary car parking serving the adjacent MOT garage to a standalone MOT testing centre (sui generis) is an intensification of use within a constrained backland site in close proximity to residential properties. The use is incompatible with the character and function of the surrounding residential environment. The proposal would therefore represent an inappropriate form of development in this location and contrary to the National Planning Policy Framework (2024), the London Plan (2021), Core Strategy Policy CP30 and Policy DMD28, which require development to be appropriate to its context and to ensure compatibility with surrounding land uses.

Reason 2

The proposed development, in the absence of a robust, evidence-based noise assessment or ventilation details, fails to demonstrate how proposed measures manage and operate to reduce exposure to noise, fumes and odours, contrary to Policies CP30 and CP32 of the Core Strategy, Policies DMD6, DMD8 and DMD68 of the Development Management Document, Policy D14 of the London Plan, and the relevant provisions of the National Planning Policy Framework.

Reason 3

The proposed development, by reason of the increase in traffic and parking demand likely to be generated from the provision of the MOT testing station would be detriment of highway safety and free flow of traffic. This would be contrary to the Policy T4 of the London Plan, DMD47 and DMD48 of the Development Management Document (2014), and Chapter 9, paragraphs 109, 115, and 116 of the NPPF, 2024.
