Prior approval for the construction of an additional fourth floor upward extension providing 9 self contained units.
The proposal fails to provide appropriate cycle parking and refuse storage to serve the development, alongside appropriate site access, prejudicial to the free flow and safety of vehicular traffic and highway users and fails to promote the use of non-sustainable modes of transport. The proposals are thereby contrary to policies DMD45 and DMD47 of the Development Management Document (2014), CP24 and CP25 of the Core Strategy (2010) and T5 and T7 of the London Plan (2021) and the NPPF (2021) and fails to satisfy Schedule 2, Part 20, Class AB, Paragraph AB.2. Condition (1)(a) of the Town and Country Planning (General Permitted Development) (Amendment) (England) Order 2015 (as amended).
The proposed development, in the absence of a legal agreement securing the development as 'car-free', would contribute unacceptably to parking congestion in the Southgate Circus Town Controlled Parking Zone which would give rise to conditions prejudicial to the free flow and safety of vehicular traffic and pedestrians, and fail to promote the use of non-sustainable modes of transport, contrary to the National Planning Policy Framework (NPPF) (2021), and thereby fails to satisfy Schedule 2, Part 20, Class AB, Paragraph AB.2. Condition (1)(a) of the Town and Country Planning (General Permitted Development) (Amendment) (England) Order 2015 (as amended).
The proposed additional storey, by virtue of its height, bulk, and massing in close proximity to the rear elevations of Nos. 7 to 17 (odd) Crown Lane, would be an overbearing form of development resulting in an unacceptable loss of outlook, privacy and light as perceived by those neighbouring properties including the enjoyment of their amenity space. The proposal would, therefore, be contrary to the policies of the National Planning Policy Framework 2021 and is refused in accordance with paragraph AB.2.(1)(g) of Class AB of Part 20 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
