Why it was refused
Reason 1

The proposed development would result in an overdevelopment of the site, by virtue of its height, mass, scale and design, resulting in a detrimental impact that fails to preserve or enhance the character and appearance of the East India Estate Conservation Area. This is contrary to the Croydon Local Plan (2018), in particular policies DM 10 and DM18, and the East India Estate Conservation Area Appraisal and Management Plan, and Policies D3, D4 and HC1 of the London Plan (2021).

Reason 2

The proposed development would be detrimental to the amenities of the occupiers of surrounding properties, resulting in an overly dominant, overbearing and oppressive impact on the rear habitable rooms and gardens of these properties, by reason of the height and massing of the proposed development and would thereby conflict with Policies SP4.1 and DM10 of the Croydon Local Plan and Policy D3 and D4 of the London Plan 20121.

Reason 3

Insufficient information has been provided to demonstrate that the refuse storage arrangements, in particular the proposed location of the refuse store adjacent to 38 Havelock Road and located on the access road, and the proposed location for bulky waste, would be incompatible with the movement of vehicles and would prevent safe access and egress to the site for vehicles and pedestrians contrary to policies DM10, DM13, and DM29 of the Croydon Local Plan (2018). In reaching this decision the Local Planning Authority has sought to work in a positive and pro-active manner based on seeking solutions to problems in the following way: To assist applicants the Local Planning Authority has produced policies and written guidance, all of which is available on the Council's website and offers a pre planning application advice service. In this instance the pre application advice was not adhered to. The Council is ready to enter into discussions with the applicants to assist in the preparation of a new planning application via the Council's Pre Application process. The Local Planning Authority delivered the decision in a timely manner.
