Change of use of the property from a single family dwelling (C3) to a House in Multiple Occupation (HMO) (Class C4) for 6 people

Why it was refused
Reason 1

The proposal results in the loss of a single family dwellinghouse for which there is a known demand in the area, and the applicant has not demonstrated that there is an identified need for the sort of accommodation proposed, thus contrary to Policies CS1 and CS5 of the Barnet's Adopted Core Strategy (2012), Policy DM01, DM08 and DM09 of the Adopted Development Management Policies DPD (2012), Policy HOU04 of the Barnet Draft Local Plan, and the Adopted Residential Design Guidance SPD (2013).

Reason 2

The proposal shows insufficient space for the storage of refuse at the front of the property alongside two off street parking spaces without using the pavement. Notwithstanding the existing situation in which bins are commonly located on the pavement, the increase in households at the property from 1 as a single family unit to 6 individuals within an HMO would require further refuse storage capacity which can only be accommodated on the highway, thus adversely affecting visual and neighbouring residential amenity, contrary to policies CS1 and CS5 of Barnet's Adopted Core Strategy (2012), policy DM01 of the Adopted Development Management Policies DPD (2012), Policy HOU04 of the Draft Barnet Local Plan and the Adopted Residential Design Guidance SPD (2016).

Reason 3

The proposal would result in substandard HMO standards and poor living conditions for future occupiers, due to the smallest bedroom on the first floor having a size of only circa 6 sqm, substantially short of the 10 sqm required for HMOs for single rooms according to HMO Standards, contrary to Policies CS1 and CS5 of the Barnet's Adopted Core Strategy (2012), Policy DM01 and DM09 of the Adopted Development Management Policies DPD (2012), Policy HOU04 of the Barnet Draft Local Plan, and the Adopted Residential Design Guidance SPD (2013).

Reason 4

The proposed development does not provide a legal agreement to mitigate the highway and car parking impacts of the proposed development. In the absence of a legal agreement to amend the traffic order, the development would result in a heightened level of parking pressure and congestion, to the detriment of highway and pedestrian safety and the free-flow of traffic, contrary to Policies T4, T6 and T6.1 of the London Plan (2021), Policy CS9 of the Local Plan Core Strategy (2012), and Policy DM17 of the Local Plan Development Management Policies DPD (2012)
