Why it was refused
Reason 1

The proposed loss of an (E) Class use on the Primary Shopping Frontage of the Chipping Barnet Town Centre and proposed use as a sui-generis (hot-food take away unit) would detract from the function of the primary retail frontage and would have a detrimental impact on the vitality and viability of the town centre. The application is contrary to Policy SD6 of The London Plan (2021), Policy CS6 of the Barnet Adopted Core Strategy (2012) and Policies DM01, DM11 of the Adopted Development Management Policies DPD (2012).

Reason 2

The proposed take away by reason of its siting within 400 metres of Queen Elizabeth Girls school and close to entrance of Barnet college would be detrimental to healthier food environment; and the siting of the proposal near several hot food take away in the area would cause proliferation of hot food takeaways in the immediate local area. The proposal would be contrary to Policy E9 of London Plan (2021) which restricts permission of hot food take way within 400m of entrance of primary or secondary school.

Reason 3

The proposal would fail to preserve the special architectural and historical interest of the listed building. No public benefit has been identified that would outweigh the harm to the heritage asset. The proposal would have a detrimental impact on the character of the original heritage building and the context of the site within Conservation Area, contrary to Policy DM01 and DM06 of Barnet's Development Management Policies Document DPD (2012), Policy CS1 and CS5 of the Barnet Core Strategy (2012), Policy D1, D3, D4, HC1 of the London Plan 2021 and the National Planning Policy Framework(2019), the Adopted Residential Design Guidance SPD (2016) and Wood Street Conservation Area Character Appraisal Statement.
