Retrospective application for the subdivision of the dwelling into two 2x bedroom flats

Why it was refused
Reason 1

The proposed development for x2 self-contained flats will result in the loss of a 3-bedroom family dwellinghouse which is the type of housing in high demand within the Borough and which policies seek to protect. The quality of the accommodation provided at the site will be reduced. The negative impact of the proposal regarding the loss of this type of housing outweighs any significant benefit. As such, having regard to the presumption in favour of sustainable development, on balance the principle of development is considered unacceptable and contrary to:- National Planning Policy Framework (December 2023); -Policies GG4, H1, H2 and H9 of the London Plan (March 2021); -Policies CM1, CM2 and CC1 of the Core Strategy DPD (July 2010); - Policy BC4 of the Borough Wide DPD (March 2011); -Policies SPDG1, SP3 and DMH4 of the Draft Local Plan (Regulation 19 Submission Version, December 2021); -Housing Supplementary Planning Guidance (GLA, March 2016, Updated August 2017); -London Borough of Barking and Dagenham Housing Delivery Test Action Plan 2020.

Reason 2

For reasons of layout, size and scale the proposed development fails to provide flats with adequate floor area or acess to daylight, sunlight and ventialation. In addition, the flats are poorely stacked which could result in uneighbourly impacts between units. Overall, the propsoal fails to provide adequate quality of accomodation harmful to the standard of living for future occupiers. The proposal is unaceptable and contrary to: - National Planning Policy Framework (December, 2023); - Policies D4 and D6 of the London Plan (March 2021); - Policies CP3, CM2 and CC1 of the LDF Core Strategy (July 2010); - Policies BP6, BP8, BP11 and BC4 of the LDF Borough Wide Development Plan Policies DPD (March 2011); - Policies SP2, SP3 and DMD1 of the Draft Local Plan (Regulation 19 Submission version, December 2021); -DCLG Technical Housing Standards (nationally described space standard) (DCLG, March 2015) (as amended).

Reason 3

The proposed development fails to provide adequate amounts of daylight and sunlight to habitable rooms, and is not designed with accessiblitiy in mind, as such is contrary to Paragraph 125(c) of the NPPF and Part C and D in Policy D6 (Housing quality and standards) and Policy D5 (Inclusive design) of the London Plan.
