Change of use from Class A1 (Retail) to Class A3 (Restaurant) with associated external alterations including erection of roofed enclosure to rear to provide outside seating area and shisha lounge.
The siting and nature of the proposed development, involving provision for a shisha bar and outdoor smoking area, would allow for commercial intensification away from the primary retail frontage and compromise the low-key character, amenity and integrity of neighbouring uses and adjoining residential properties. The proposed change of use to provide a restaurant and shisha bar is therefore considered contrary to the objectives of policies 7.1 and 7.4 of the London Plan, policies D1 and D4 of the Draft London Plan, policies CM1 and CP3 of the Core Strategy, policies BP8 and BP11 of the Development Plan Document and policies SP4, DM11 and DM25 of the Draft Local Plan.
The proposed external alterations, and most notably the retractable roof to the rear, would have an unacceptable visual impact upon the local built form and fail to support the health and wellbeing of the users of the development. The design of the proposed development is therefore considered contrary to the objectives outlined in policies 7.1 and 7.4 of the London Plan, policy D4 of the Draft London Plan, policy CP3 of the Core Strategy, policy BP8 of the Development Plan Document and policies SP4 and DM11 of the Draft Local Plan.
The potential noise and odour nuisance, emergency and delivery access into Herbert Gardens and overall intensification of activity at the site would adversely impact the amenity of neighbouring occupiers. The proposed development is therefore contrary to the neighbourly development objectives set out in policy CP3 of the Core Strategy, policies BP8 and BP11 of the Development Plan Document and policies SP4 and DM11 of the Draft Local Plan.
